General terms and conditions for ordering and processing personal data in Baltichouse Production e-shop

Baltichouse Production OÜ, reg. code 11669568, (hereinafter referred to as the Seller) and the customer, who places an order in the Seller’s e-shop and identifies himself by entering his personal data in the order (hereinafter referred to as the Buyer), entered into this e-shop Agreement (hereinafter referred to as the Agreement).
1. E-POOD
1.1 Baltichouse Production E-shop (hereinafter E-shop) is an online store created by the Seller, through which the sale of products to the Buyer takes place.
2. OVERVIEWS
2.1. In regulating their mutual relations, the contracting parties shall be guided by the Law of Obligations Act and other laws of the Republic of Estonia and other legislation and by what is agreed in the e-shop Agreement.
2.2. The Seller reserves the right to make changes, without prior notice, to the e-shop service and the terms and conditions of the services offered.
3. PRODUCTS AND MAKING A PURCHASE
3.1 The products displayed in the online shop are normally in stock.
3.2 If the product is out of stock and the order cannot be fulfilled, the Seller will contact the Buyer and offer a possible new delivery time or replacement of the product with another product of the same price and quality, or a refund of the money paid. The Buyer will be refunded immediately, but not later than 14 days after the order has been placed.
3.3 The product images displayed are illustrative and may differ from the actual product.The product descriptions in the epo may not be exhaustive and may contain unintentional errors.
3.5 The Buyer declares that he/she is at least 18 years of age.
3.6 The Buyer selects the desired product and undertakes to enter the information required to complete the order and to pay for the products by means of an Internet bank transfer, credit card or prepayment invoice.
3.7 The Buyer undertakes to provide correct information necessary for the execution of the order. The Seller shall not be liable for the non-fulfilment of the order or for any consequences arising therefrom as a result of incorrect information provided by the Buyer.
3.8 A sale will take place when the Buyer has placed an order via the e-shop’s website and has paid for the order.
4. PRICES
4.1. All prices shown in the online shop are in Euro and include VAT.
4.2. The Seller reserves the right to modify the prices displayed in the e-shop at any time. If the prices on the e-shop have been changed after the Buyer has placed and paid for the order, the Seller undertakes to deliver the corresponding products to the User at the prices valid at the time of the order. The Buyer shall not be entitled to claim compensation for any price difference.
5. DELIVERY TIME AND DELIVERY TERMS
5.1 The Buyer may choose between two methods of delivery:
5.1.1 The Goods shall be delivered to the Buyer within the Republic of Estonia by transport arranged by the Seller.
5.1.2 The Buyer shall collect the Goods in person from the Seller’s warehouse at the address Risu tee 2, Pihva village, Tartumaa.
5.2 The exact time of transport shall be agreed in writing between the Buyer and the Seller. In the event of the Seller’s choice of transport, the Buyer shall pay for the service after the transport has been carried out. The Seller shall carry out the transport within 14 days unless otherwise agreed.
5.3 If the Buyer collects the Goods himself/herself, he/she will be informed by e-mail or telephone when the Goods are ready for dispatch. The information will be sent as soon as possible, but not later than 5 working days after the payment has been credited to the Seller’s account.
5.4 The delivery of the Goods to the Buyer’s transport shall take place Monday to Friday between 8.00 and 15.00. Delivery will be made on the agreed date on a live queue basis (no time will be booked).
5.5 The Goods shall be delivered only to the Buyer indicated in the order on the basis of an identity document. Goods shall be delivered to third parties only with the prior agreement of the Buyer with the Seller.
5.6 Goods are packed in weatherproof packaging. The Buyer must take into account that the packaging of the products is bulky and heavy:
- Dimensions: length 3.0 – 6.3 m, height from 0.5 m.
- Weight: 0.5 – 2.5 tonnes (larger houses may be split into several packages).
- The exact packaging details are given separately for each product.
5.7 In the case of the Seller’s transport service, the Buyer shall ensure unrestricted and safe access to the loading point for the transport vehicle with crane. In the case of the Seller’s Transport Service, the Buyer shall ensure that the access roads and the unloading place are suitable for a truck with the following parameters:
- Crane truck dimensions (L x W x H) 10 650 mm x 2 550 mm x 4000 mm
- Crane truck mass 21 000 kg – 32 000 kg
5.8 The Buyer is responsible for the suitability of the conditions prevailing at the destination (site). In the event that the means of transport becomes significantly dirty at the destination or becomes stuck due to unsuitable road conditions, the Buyer undertakes to reimburse the direct costs of cleaning and/or towing the machine.
5.9 The Buyer shall be liable for any damage to the means of transport caused by the conditions prevailing at the destination or by the instructions given by the Buyer when manoeuvring the means of transport and/or unloading the goods.
5.10 If the goods cannot be delivered to the Buyer for reasons attributable to the Buyer (e.g. no access to the object, the Buyer is not at the agreed destination at the agreed time, road conditions do not allow manoeuvring, etc.), the Seller is entitled to charge the Buyer an empty journey fee and an additional fee for a new delivery in accordance with the applicable price list.
6. WITHDRAWAL FROM THE CONTRACT
6.1 If the Buyer wishes to withdraw from the contract after the order has been placed and prior to its execution by the Seller, the Buyer undertakes to notify the Seller in writing as soon as possible. The written notice must be sent by e-mail to pood@baltichouse.eu . The e-mail must contain the details of the order (the goods purchased) from which the withdrawal is requested and the Buyer’s contact details (first name, surname, date of order, contact telephone number).
6.2 If the request for withdrawal reaches the Seller after the execution of the Contract by the Seller, the withdrawal from the Contract shall be effected in accordance with the chapter of the Contract entitled “Right of withdrawal”.
6.3 The right of free withdrawal applies to the purchase of products at the regular price. In the case of cancellation of an order for discounted or promotional products, if the order has already been paid for,
Seller shall be entitled to charge the Buyer an order handling fee equal to 30% of the value of the ordered product, which shall be deducted by the Seller from the funds refunded to the Buyer.
6.4 If the Seller has already incurred additional transport costs in connection with the Buyer’s order, for example, if the goods have already been loaded for transport or dispatched to the Buyer, the Buyer is obliged to reimburse the cost of transport agreed between the parties.
6.5 The Seller shall reimburse to the Buyer the amount paid without undue delay, but not later than 14 days from the receipt of the notice of withdrawal.
6.6 The money will be transferred to the same bank account from which it was received by the Seller.
7. RIGHT OF WITHDRAWAL
7.1 Contracts concluded in the e-shop are subject to a 14-day right of withdrawal, which must be submitted to the Seller in a written, reproducible form. The period starts on the day on which the goods are delivered to the Buyer. If the Buyer decides to withdraw from the contract, he is obliged to return the goods to the Provider.
7.2 The product to be returned must be undamaged, complete, unopened, in its original packaging and unused.
7.3 The right of return does not apply to goods in open packaging.
7.4 In order to return a product, a return notice must be submitted by e-mail to pood@baltichouse.eu The return notice must contain the following information – buyer’s details (name, contacts), date of purchase, purchase document (invoice) number, house pack number (can be found on the packing label or in the installation instructions supplied with the product), date of discovery of the defect, reason for return / description of the claim, photos to prove the claim.
7.5 In the event of withdrawal from the contract, the consumer must return the purchased goods without delay, but not later than 14 days after the notice of withdrawal.
7.6 The Buyer undertakes to bear the costs of returning the goods, unless the goods to be returned do not correspond to the consumer’s order.
7.7 If, after the goods have been returned, it is found that the goods do not comply with the terms and conditions set out in clauses 7.1 – 7.4 of the Contract, the money shall not be refunded to the Buyer and the returned product shall remain in the Seller’s storage. The costs of storage or return of the Product to the Buyer shall be borne by the Buyer.
8. COMPLAINTS PROCEDURE
8.1 For products sold from the e-shop, the 2-year period for lodging a complaint provided for in Section 218(2) of the VAT Act applies, within the first 6 months of which the origin of the defect shall be determined by the Seller.
9. PERSONAL DATA AND THEIR USE
9.1 The Buyer gives clear and informed consent to the Seller to process his/her personal data.
9.2 The personal data of the Buyer entered by the User when placing the Order and made known to the Seller shall be entered in the customer register and used for the provision of the sales service and the offer of the goods to the Buyer.
9.3 When requesting card details, secure SSL data transmission and MasterCard SecureCode and Verified by Visa security systems are used.
9.4 The card details entered will not be visible to the Seller. The Cardholder will be redirected to the secure environment of the Card Centre (Pankade Kaardikeskuse AS www.estcard.ee) for the transaction. At the time of payment, the Cardholder’s Card details are entered by the Cardholder into a database on the Card Centre server and are also stored on the Card Centre server.
9.5 The source of personal data is the establishment of the customer relationship when placing an order in the e-shop.
9.6 The personal data to be recorded include data concerning the Buyer’s order – surname, first name(s), street, house, apartment number, town or city, postal code, telephone number, address, delivery method, payment method used, acceptance of the E-shop Agreement, acceptance of sending sales offers, free text comments to the e-mail address.
9.7 Personal data is processed by Baltichouse Production OÜ, reg.code 11669568, with the address Tõrvandi alevik, Ülenurme Tehnopark, Tööstuse tee 2.
9.8 The Buyer’s personal data necessary for the mediation of the goods to the Buyer shall be transmitted to the company providing the transport service.
9.9 The protection of personal data is ensured by all legal security measures.
9.10 The Seller undertakes not to disclose the registered personal data to unauthorised persons.
9.11 The Seller reserves the right to transfer personal data concerning the Buyer to persons who have a legal right to do so and who process the data in order to fulfil a legal obligation and to persons who have a legal right to do so and this is done in order to protect the life, health or freedom of the Buyer or another person.
9.12 The Buyer has the right to check the personal data concerning him or her, as well as the right to modify such data or to request the removal of his or her personal data from the register.
9.13 The Buyer consents to the Seller to send an order confirmation to the e-mail address entered when placing the order.
9.14 The Buyer agrees to the Seller to send offers for sale to the e-mail address provided when placing the order, provided that the Buyer has indicated his agreement to the general terms and conditions of the order.
10.
10.1 The Seller is liable for the sale price of the Product. The Seller shall not be liable for any loss or damage caused by defective products, such as damage to property, loss of turnover or loss of profit.
10.2 The Buyer undertakes to use the e-shop service only in accordance with the law and good practice.
10.3 The Buyer shall be responsible for all costs associated with the purchase and maintenance of all software data communication systems for the equipment required for use, as well as for any other costs arising from the use of the e-shop Service.
10.4 The Buyer shall be fully liable for any damage caused to the Seller, other Buyers or third parties as a result of the use of the E-shop in violation of the terms and conditions of the Contract or in violation of the law or good practice.
11. DISAGREEMENTS
11.1 Any disputes arising from the Contract between the Buyer and the Seller shall be settled in accordance with the legislation in force in the Republic of Estonia. In case of failure to reach an agreement, the disagreements shall be settled
in Tartu County Court.
12. CONDITIONS OF USE
12.1 It is obligatory for the Buyer to familiarise himself with the terms and conditions set out in the Contract.
12.2 By placing an Order, the Buyer agrees that it has read and understood the terms and conditions set out in the Agreement
and agrees to be bound by the terms and conditions set out in the Agreement, by ticking the appropriate box “I agree to the general terms and conditions for ordering and processing personal data”.
The terms and conditions are valid from 01.02.2016 and are open-ended. The Seller reserves the right to unilaterally modify the Terms and Conditions at any time, with the modifications taking effect from the moment of their publication on the Seller’s website.
